Abstract

تتحدث هذه الدراسة عن تأثير الخلافات النحوية على الحكم الفقهي، فالرأي النحوي مبني على المعنى الموجود في ذهن المعرب، فإذا تعددت الآراء النحوية في إعراب كلمة في تركيب ما من التركيب، تأثرت أفهامنا بهذا الاختلاف، وظهر لكل رأي نحوي معنى مخالف للآخر وقد بين الباحث هنا أن تعدد الآراء النحوية في آيات الأحكام يؤثر على الحكم الفقهي، ويغير فهمنا له، كما وضح أن تعدد الآراء الفقهية مرتبط بتعدد الآراء النحوية، وبين أيضا بعض أسباب تعدد الآراء النحوية في آيات الأحكام واختار الباحث عددا من آيات الأحكام، فقام بدراستها دراسة مفصلة، وبين آراء النحاة المختلفة في إعراب هذه الآيات، وقام بإيضاح أثر الخلاف النحوي في إعراب الآيات على الحكم الفقهي، وقد استعان الباحث في ترجيحه للآراء بما ذكره المفسرون والفقهاء

This study talks about the effect of syntactic differences on juristic verdicts The syntactic view point is based on the meaning the analyst has in his mind so if there are more than one opinion is analyzing a word in a certain structure our perception will be affected by these different opinions and every syntactic opinion will have a different meaning The researcher shows here that the large number of syntactic view points affect the juristic verdict and change our understanding to it Also he clarifies that the large number of the juristic views is associated with the large number of the syntactic views and he shows why there are many syntactic views in verdict verses The researcher has chosen a number of verdict verses and studied; then in details and he shows the different view points of the analysists in analyzing these Then he clarified the effect of the syntactic disagreement of analyzing the verses on the juristic verses The researcher used in opting for the views what the interpreters and jurists have mentioned
