استصحاب الحال بين أصول الفقه وأصول النحو The past condition reference (isstisshab AlHal) between philology and syntax

Abstract

يعالج البحث قضية من قضايا النحو العربي، هي قضية في أصول النحو، اعتمدها النحويون وأخذوا بها في مسائل كثيرة من مسائلهم النحوية، وهي من ثم قضية وثيقة الصلة بأصول الفقه تسمى "استصحاب الحال" علما بأن البحث ليس قضية فقهية خالصة وإن كان له مساس ب "أصول الفقه" إن صلة علم النحو بعلم الفقه قوية وواضحة كل الوضوح، وإن الدارس اللغوي العربي منذ عصوره الأولى يكاد يلمس فيه التوجيه الأصولي وقد نص غير واحد من الأصوليين على أن معرفة اللغة العربية إفرادا وتركيبا من شروط الاجتهاد ؛ لأنه يقوم على الأدلة الأربعة القرآن الكريم، والسنة، والإجماع، والقياس، وفهمها مرتبط ارتباطا وثيقًا بفهم اللغة العربية يعد الاستصحاب من الموضوعات الرئيسة في النحو العربي وأصوله، فيه تظهر عبقرية نحاة العربية في طرائقهم في النظر إلى مسائل النحو، وما امتازوا به من دقة النظر في استصحاب الحال من حيث تعريفه لغة واصطلاحا، وحجته، وأقسامه، وأثره عند الفقهاء النظر في استصحاب الحال في علم أصول النحو، والذي يبدو أن المصطلح لم يظهر منذ سيبويه إلى ابن الأنباري، لكنه استدل عليه في مواضع كثيرة من كتابهدور أبي البركات الأنباري في نقل المصطلح من أصول الفقه إلى أصول ال نحو، بل ويعد ابن الأنباري واضعا معالم هذه النظرية في النحو العربي دون منازع يعرض البحث عددا من مسائل الاستصحاب كما جاءت عند النحويين من بصريين وكوفيين جدولة إحصائية هامة جدا لمسائل الاستصحاب في بعض كتب الأصول النحوية، لتكون إضاءة لمن أراد أن يطلع على مسائل هذا الموضوع

The Past Condition Reference (Isstisshab AlHal) is considered one of the major topics in Arabic Syntax and its rules The genius of Arab syntacticians become evident in their approaches and singular precision in explicating syntactic problems The relationship between Syntax and Philology is crystal clear in Arabic and any Arab linguist since the first periods of this science would feel the effects of the traditionalist approach in it More than one traditionalist emphasized that a knowledge of the individual parts and the whole structures of Arabic constitutes an essential condition for interpretation because this interpretation is built upon the four known references the Holy Qura'n the Sunna consensus and analogy Understanding parts and structures is strongly related to the understanding of Arabic This paper deals with a linguistic case in Arabic Syntax mainly in Dogmatic Syntax Linguists adopted it for use in many of the linguistic cases they tackled; therefore it is a case well related to the paradigm of Philology labled as Past Condition Reference (Isstisshab AlHal) However this research paper is not a pure philological case though it touches upon the principles of philology The traditionalist approach is employed in the treatment of this reference issue that is in terms of terminological and linguistic definition its justification its types and its effect according to philologists Then the paper moves to the study of the Past Condition Reference as found in the origins of Syntax The term seems not to occur in Sebaweyh but many of his indications to it occur in various places of his book Not unitl Abi Barakat AlAnbari moved the term from the principles of Philology to the principles of Syntax that Isstisshab AlHal began to occur in linguistic studies In fact AlAnbari is considered the sole author of the features of this paradigm in Arabic grammar In addition the degree to which syntacticians undertook the issue is raised on two levels theory and practice This paper presents many of AlIsstisshab's problems as treated by the grammarians of Bassrah and Kufah A statistical table for the most important issues related to Isstisshab as found in references on syntax is provided to guide the reader in related issues
