الحمد لله والصلاة والسلام على رسوله محمد وآله وصحبه وبعد فقد تناول هذا البحث دراسة قاعدة من قواعد أصول الفقه، وهي (ترك الاستفصال في حكايات الأحوال مع قيام الاحتمال ينزل منزلة العموم في المقال) وذلك من جهتين إحداهما أصولية ببيان معنى القاعدة وحجيتها مع ذكر الدلائل والمناقشات، وقد تبين من خلال البحث والتمحيص أن القاعدة حجة عند المذاهب الأربعة، وأن المخالف هو الجويني والهراسي والغزالي والرازي والآمدي، كما تطرق البحث الأصولي إلى ذكر شروط العمل بقاعدة ترك الاستفصال، وإلى تخصيص القاعدة للعموم والتخصيص بها، إلى غير ذلك من المباحث وأما الجهة الثانية فكانت تطبيقية، فيما يعرف عند الأصوليين بـ "تخريج الفروع على الأصول"، حيث انتظم اثنتي عشرة مسألة فرعية انبنت على الاحتجاج بالقاعدة، وذلك من خلال اختيار ثلاث مسائل لكل مذهب
